A11366 (Taylor)/S10581 (Bailey)  

An act to amend chapter 490 of the laws of 2017 amending the insurance law relating to limits on certain supplementary insurance, in relation to the effectiveness thereof

This bill would extend the supplementary uninsured/underinsured motorist (SUM) insurance coverage statute until 2029. This provision was set to expire on June 30, 2026, and the new statute provides a new sunset date of June 30, 2029.

Action: Chapter 149 of the laws of 2026; signed by the Governor on June 29, 2026.

Effective Date: This act shall take effect immediately (June 29, 2026).

 

A11367 (Hunter)/S10582 (Bailey)  

An act to amend the insurance law, in relation to extending provisions of the property/casualty insurance availability act and the authority of the New York property insurance underwriting association

This bill would extend several provisions of the insurance law that were set to expire on June 30, 2026, and would provide a new sunset date of June 30, 2029. This includes provisions on:

  • Delegation of rate filing obligations to rate service organization [Insurance Law § 2307(c)]
  • Authorizes DFS to switch lines from file-and-use to prior approval [Insurance Law § 2308]
  • Requires rate/rule changes before implementation of file-and-use [Insurance Law § 2310(a)]
  • Prohibition of anti-competitive behavior [Insurance Law § 2316]
  • DFS authority to examine compliance with rate laws [Insurance Law § 2320]
  • Profitability and rate of return [Insurance Law § 2323]
  • Evaluation of competitive rating provisions [Insurance Law § 2326]
  • Prohibition of surcharges for auto liability rates [Insurance Law § 2335]
  • Mandatory premium reductions for auto coverages [Insurance Law § 2336(b)]
  • Fillings that require prior authorization [Insurance Law § 2305(f)]
  • Flexible rate limitations in problem markets [Insurance Law § 2344(h)]
  • "Two percent rule" and "two-for-one credit” rules [Insurance Law § 3425(m)]
  • NYPIUA authorization [Insurance Law § 5412(g)]

Action: Chapter 150 of the laws of 2026; signed by the Governor on June 29, 2026.

Effective Date: This act shall take effect immediately (June 29, 2026).
