DFS Hosts Webinar on Motor Vehicle Reforms

DFS held a webinar this afternoon to address questions related to the Circular Letter 3 and the expected rate decreases due to the budget reforms. NYIA submitted questions on behalf of companies in advance of the webinar on an anonymous basis ahead of the call. DFS’ responses provided broad requirements for the new Exhibit TR-1 and what should be incorporated into rate filings moving forward.

Updated Responses on Premium Change Notifications

NYIA is sharing additional responses on several questions raised by members regarding the premium change notice requirements. Not all questions asked to date have been answered. NY Courts Propose Changes to Surrogates Court Rule on Litigation Financing Disclosures

The Unified Court System has proposed amendments to Section 207.38 of the Uniform Rules for Surrogate’s Court. The amendments would expand required disclosure of in camera submissions regarding litigation financing or other settlement-related financial agreements to a guardian ad litem and any party objecting to the proposed allocation and or distribution of proceeds. The proposal would not apply to attorney financing agreements that affect only the attorney. Public comments can be submitted to JSCcertification@nycourts.gov by August 14, 2026. DFS Adopts Regulation on Changes to NF-10 Form

DFS has adopted the regulation to update the prescribed No-Fault Denial of Claim NF-10 Form. The regulation amends the NF-10 form with technical changes. The new form adds a link for filing a dispute with the American Arbitration Association (AAA) electronically through its Simple File portal; updates AAA’s contact information; adds spaces to insert the email addresses of an insurer’s representative and a third-party administrator’s representative; removes the signature and date fields from the “Arbitration Requested By” section; and adds signature and date lines directly below the fraud warning statement. Governor Issues Executive Order on Regulatory Reset

Governor Kathy Hochul issued an Executive Order to commence New York’s “Regulatory Reset,” a review of thousands of regulations and laws across all state agencies, to improve the functioning and efficiency of state government. Through this “Regulatory Reset,” agencies will reform outdated regulations, fees, and requirements that are duplicative or unnecessary. This effort is part of a broader EXPRESS NY initiative to cut regulatory red tape. While this first announcement did not include changes pertaining to DFS, NYIA believes this overall effort will marry well with what we are putting forward as a Regulatory Roadmap.
