DFS Pre-Proposes Amendments on Free Trade Zone

DFS has pre-proposed a regulation regarding the free trade zone (FTZ). The amendments would eliminate the requirement that an insurer underwrite and transact FTZ business from an office within New York, to conform to chapter 550 of the laws of 2025. The amendments would also conform to statutory provisions by prohibiting insurers from writing in the FTZ insurance required to satisfy the financial responsibility requirements and remove statistical code 2-13001 (Automobile Personal Injury Protection Excess of $150,000) as a class 2 risk to conform to the regulatory definition of such risks. NYIA Attends Affordability Forum

Last week, NYIA attended an affordability forum hosted by Senator James Sanders, Jr. in Rockaway, Queens. The forum surrounded how homeowners can reduce home, flood, and auto insurance costs in addition to electric and heating bills. Senator Peter Harckham and Assemblymember Khaleel Anderson, members of their respective insurance committees, were also in attendance. NYIA’s remarks surrounded risk mitigation technologies and infrastructure like the FORTIFIED standard that minimizes losses.

NAIC Security Incident

On June 17, 2026, the National Association of Insurance Commissioners (NAIC) publicly disclosed that it identified unauthorized access to its PeopleSoft systems on or about June 11, 2026. The NAIC activated its incident response procedures and is working with cybersecurity experts to assess the situation. The full scope of the breach has not been determined, and the NAIC has stated it cannot yet confirm what information was affected. NAIC, however confirmed that data taken in the hack has been published online including publicly available statutory financial reporting information as well as credit rating agency data and rating determinations of insurer investments. WCB Proposes Amendments to Correct Contact Information

The Workers Compensation Board (WCB) proposed amendments to Sections 325-1.6, 328.12, 342.10, 347.9, 349-2.11, 425.2, 425.3, 425.6, 430.2, 430.4, 430.8, and 441.2 of Title 12 of the NYCRR to update contact information (website URLs, mailing addresses, email addresses, phone numbers, etc.), correct typographical errors, and update to gender neutral language. Public comments can be submitted until August 23, 2026, to regulations@wcb.ny.gov. DMV Proposed Regulation on Airport Transit Solicitation

The Department of Motor Vehicles (DMV) has proposed a regulation to prohibit the unauthorized solicitation, acceptance, pickup, or transportation of passengers for compensation at airports—commonly known as "hustling"—by imposing a two-point DMV violation. The text of the proposed rule can be found on page 7 of the state register. Public comments can be submitted until August 23, 2026, to dmv.sm.legal@dmv.ny.gov. NYCIRB Files Set of Loss Costs

The New York Compensation Insurance Rating Board (NYCIRB) has derived a preliminary set of loss costs, by classification code, associated with the Board’s pending 2026 aggregate loss cost level filing. In years past, loss costs by classification have been published only once they have been approved by DFS, i.e., on or around July 15. However, in light of the significant magnitude of the 2026 aggregate loss cost level change, NYCIRB has published preliminary loss costs by classification prior to approval to provide member insurers with additional time to review in anticipation of October 1 renewals. Please know that 2026 aggregate loss cost level filing has not yet been approved by DFS; while DFS has reviewed the preliminary set of loss costs by classification, DFS has not yet issued approval, and classification loss costs are subject to change until approval. The final set of 2026 loss costs by classification will be published upon approval.
