Legislative Introduction Bulletin 01.05.26
Legislative Introduction Bulletin 01.05.26 contains bills of interest that have been added to NYIA's tracking list during the off session. If you would like a copy of a particular bill or sponsor memo, please visit the Senate or Assembly websites, which are linked in the bulletin.
The document includes the following key bills:

- S8583A (Kavanagh) - Requires property/casualty insurance companies to submit certain data to the department of financial services and authorizes premium discounts to policyholders who demonstrate certain mitigation actions. There is currently no corresponding bill in the Assembly. NYIA opposes. NYIA has compiled an initial summary of the provisions of this bill.
- A9390 (Berger) - Prohibits public adjusters from initiating contact with, soliciting, or approaching owners, occupants, tenants, or other affected parties regarding commercial or residential property that has sustained damage from a damaging event within seventy-two hours of such damaging event; establishes reimbursement and written notice requirements for such adjusters. There is currently no corresponding bill in the Senate. NYIA strongly supports.
- A9369 (Berger) - Relates to schedule rating plans reflecting individual risk characteristics of an employer. There is currently no corresponding bill in the Senate. NYIA supports as a priority initiative.
As any of these bills move through the legislative process, we will notify you under separate cover and take appropriate action on your behalf. As a reminder, New York has a two-year legislative term, so all the bills introduced in 2025 that did not pass both houses, are still in play during 2026. If any member has a different viewpoint than the recommended position and priority listed, you’re encouraged to contact NYIA at your earliest convenience. NYIA will continue to monitor the bills introduced in 2025 and any new bills introduced in 2026.
If you have any questions on any of these pieces of legislation, please contact Bob Farley at bfarley@nyia.org or Staci Steinfeld at ssteinfeld@nyia.org. If you would like a complete Excel spreadsheet of all bills introduced in the 2025-2026 session that are being tracked by NYIA, please contact Staci.
As the Legislature convenes a new session, bills will be introduced more frequently, and NYIA will be issuing Legislative Introduction Bulletins on a more regular basis.
