The following bill related to online verification system for motor vehicle insurance, a NYIA priority initiative, has been enacted into law after being signed by Governor Hochul. A4404A (Weprin) / S5331A (Bailey) AN ACT to amend the vehicle and traffic law, in relation to establishing an online insurance verification system for motor vehicle insurance The bill would amend Article 6 of the Vehicle and Traffic Law (VTL), sections 321-a, 312-b, 312-c, 313, and 317, to allow the New York State Department of Motor Vehicles (DMV) to institute an Online Verification System for automobile insurance. The Insurance Information and Enforcement System (IIES) was established in the late 1990s to monitor the insurance status of New York State registered vehicles and become a centralized database of insurance and registration information for the Department of Motor Vehicles (DMV). Insurance carriers are required to report specific policyholder transactions to IIES, within designated timeframes, however the outdated processes of IIES impede accurate and timely reporting. A motorist’s insurance status cannot be instantly verified in real-time through IIES and the verification process is highly susceptible to keystroke errors that obstruct submission and verification. Since the IIES platform was first implemented in New York, the technology surrounding the reporting of auto liability insurance has significantly advanced. Technology now exists to perform instant, real-time insurance verification, through online verification systems (OLV). This bill would bring 21st century OLV technology to New York’s auto liability insurance reporting protocols and would significantly enhance New York’s motorist customer experience, and create a more accurate, efficient, and seamless manner of verifying insurance coverage.

Effective Date: This act shall take effect on December 31, 2028. We anticipate in advance of this date there will be proposed regulations to implement the OLV system, which NYIA will be engaging in with members.
